CrescentiaOS terms of use

1. Who we are

2. The service

CrescentiaOS is a web application to plan and track a company's execution: strategic and annual plan, priorities, metrics, key functions, meetings, org chart and Scorecard.

We may improve, change or retire features of the service. If a change materially reduces what you subscribed to, we will give you reasonable advance notice.

3. Accounts and licenses

Each license is for one named user. Licenses are sold in blocks of 5, with a minimum of 5.

The customer is responsible for who has access to its account, for keeping passwords secure and for what its users do in CrescentiaOS. Let us know right away if you suspect unauthorized access.

4. Pricing and payment

Prices are in US dollars (USD) and do not include VAT or other applicable taxes, which are added to the invoice.

Payment is by card. The monthly plan is charged in advance each month and renews automatically until you cancel.

Customers in a coaching program prepay their licenses for 3, 6 or 12 months at their program's price. When the program ends they keep that price as long as they keep prepaying the same period; if they switch to monthly payment, the license goes back to the current monthly price.

We may change prices with at least 30 days' notice. The change applies from the next billing period.

5. Cancellation and refunds

You can cancel the monthly plan at any time. You keep access until the end of the period already paid and there are no further charges.

Prepayments are non-refundable, in whole or in part.

6. Your data

The information your company enters in CrescentiaOS is yours. We use it only to provide the service, support you and improve the product, and we don't sell it.

We apply reasonable security measures to protect it. No system is completely infallible, so we cannot guarantee absolute security.

When your subscription ends you can ask us for a copy of your information within the following 30 days. After that we may delete it.

How we handle personal data on our website is described in the Privacy notice.

7. Acceptable use

You may not use CrescentiaOS for illegal activities; try to access other people's accounts or data; copy, resell or reverse-engineer the software; upload malicious code; or overload or interfere with the service.

We may suspend an account that breaches these terms. Unless the risk is urgent, we will warn you first and give you a chance to fix it.

8. Availability and support

We work to keep CrescentiaOS available at all times, but there may be interruptions for maintenance, failures or causes beyond our control. We do not guarantee a specific level of availability.

9. Intellectual property

CrescentiaOS, its design, code and trademarks belong to CrescentiaLab. Your subscription grants you a limited, non-exclusive, non-transferable right to use it while it is active.

If you send us suggestions, we may use them to improve the product without any obligation to you.

EOS® and Scaling Up® are registered trademarks of their respective owners. CrescentiaLab is not affiliated with or endorsed by them.

10. Warranties and liability

CrescentiaOS is provided "as is" and "as available". It is a management tool: business decisions and their results are the customer's responsibility.

To the extent permitted by law, CrescentiaLab is not liable for indirect damages, lost profits or loss of data or business. Our total liability will not exceed what the customer paid for CrescentiaOS in the 12 months before the event that gave rise to it.

11. Changes to these terms

We may update these terms. We will post the new version on this page with its date and, if the change is significant, notify you by email. If you keep using CrescentiaOS after the change, you accept the new version.

12. Governing law

These terms are governed by the laws of the State of Florida, United States. Any dispute will be resolved before the competent courts of Florida.
